1. CLOUDEGY TECHNOLOGY LIMITED (hereinafter referred to as “CLOUDEGY,” “we,” depending on the case) would like to send our customers (“You,” “User,” “Customer,” or “Subscriber” meaning individuals or organizations engaging with us to use the service) the terms and conditions for using the service. By using CLOUDEGY services, the customer agrees to the clearly defined terms in this document (Terms of Service) and the specific terms of use for each service.
  2. Service Usage Regulations.
    We reserve the right to lock the customer’s service or refuse future service if the following usage regulations are violated:
    1. Using the service to engage in activities that violate the laws of the India and the international regulations currently applied in India.
    2. Using the service to spread sensitive content, obscene cultural materials, affecting Indian morals and customs.
    3. Using server services or server resources to disseminate SPAM emails, advertisements, BULK, MASS MAIL,… or any form of sending emails in large quantities that affects the reputation of IP ranges at CLOUDEGY.
    4. Distributing and storing malware to attack other websites or destroy CLOUDEGY systems, such as Botnet, DDoS, Malware, Virus, Phishing. This includes websites containing malware.
    5. Using the server service to host websites impersonating individuals or organizations that harm the reputation and dignity of others.
    6. Using software that abuses CPU and other server resources like Coin Mining, or similar website traffic exchange software like Hitleap…
    7. Using the service to store copyrighted content or material violating intellectual property rights.
  3. Customer Responsibilities.
    CLOUDEGY customers have all the rights and obligations of a service tenant as stipulated in the Law of India. To ensure the best benefits, customers must also comply with the following rules:
    1. Customers are responsible for securing login information to the website system or customer control panel at CLOUDEGY. Customers must notify us if they detect unauthorized password use.
    2. Customers are responsible for the content uploaded to websites and stored on CLOUDEGY servers before the law in case of disputes or lawsuits.
    3. Customers are responsible for maintaining and safeguarding the website and are liable for damages caused by negligence or lax management.
    4. Customers are responsible for safeguarding data and source code on CLOUDEGY storage systems. CLOUDEGY is not responsible for data loss caused by poor usage or weak security by the customer.
    5. Customers must provide accurate registration information of individuals or organizations for the service and ensure that all related documents sent to us, such as IDs and Passports, are accurate when required.
  4. CLOUDEGY Responsibilities
    As a service provider, CLOUDEGY has all the rights and obligations of a service provider as stipulated in the Law of India. CLOUDEGY has the following responsibilities:
    1. Provide services with technical specifications as committed on the egynode.com homepage.
    2. Support customers throughout the service usage period according to the support policy in the terms of each service.
    3. Fully notify customers about service maintenance schedules or changes in services.
    4. Adhere to other commitments in this document and related legal documents.
  5. Service Suspension.
    Your service may be suspended without prior notice but will receive an email notification when service suspension has occurred in the following cases:
    1. Overdue payment by 15 days from the service expiration date.
    2. The service violates the applicable service usage policy.
    3. There are disputes, lawsuits, or legal inspections.
  6. IP Usage.
    Each customer registering for the service may only use IPs provided by CLOUDEGY, including IPs available on the server and additional purchased IPs. If the customer configures the machine to use an unauthorized IP, they will receive a warning email. Repeat offenses will result in permanent service termination without a refund, and future service will be denied.
  7. Account Registration
    Accounts on the CLOUDEGY service management system are customer-created during service registration. These accounts allow tracking service periods, making payments, renewing services, submitting support requests, and using specific functions for each service. All new accounts must be registered with valid, verifiable information. Accounts registered with false information will be deleted without notice. Multiple accounts for one user are not allowed. You must provide accurate and timely confirmation information during your service use with CLOUDEGY. We may verify any changes to your information, and if verification cannot be received, we have the right to suspend or terminate your service.
  8. Service Cancellation
    You must submit a cancellation request from your service management area to terminate the service. You can cancel the service anytime for any reason. All funds in your account will be forfeited upon cancellation. You may request us to delete all your personal information at the time of cancellation. All your data on CLOUDEGY services will be deleted upon service cancellation.
  9. Billing and Payment Information.
    1. Payment Methods
      CLOUDEGY supports three payment methods: Bank Transfer and Payment Gateway Provided by CLOUDEGY. Customers can choose a suitable payment method, and service activation time will depend on the payment method. For PayPal payments, services will be automatically activated upon payment completion. For bank transfers, services will be activated once CLOUDEGY receives the payment as per instructions.
    2. Advance Payments
      All services require advance payment to maintain the service. For service renewals, invoices will be auto-generated 15 days before the due date, notifying customers to make advance payments to avoid service suspension due to late payment.
    3. Automatic Renewal
      If paying via Gateway, customers accept that this method supports automatic service renewal. For service cancellation, ensure that Preapprove Payment from CLOUDEGY is disabled in your Gateway account to avoid auto-payments for canceled services. This Gateway feature is beyond CLOUDEGY’s control.
    4. Taxes
      Customers are responsible for paying applicable taxes for each service. All service prices on the EgyNode.COM homepage are exclusive of GST.
    5. Late Payments
      Customers must pay for service maintenance on time. Services will be automatically locked after 7 days of overdue payment, and data will be permanently deleted after 30 days without renewal.
    6. Payment Rejections
      We reserve the right to reject payments found to be non-transparent or suspected of criminal activity.
    7. Refunds
      We accept refund requests within 10 days of service activation. Refund requests must comply with our refund policy, and 100% refunds are not applicable for service violations.
  10. Support.
    You must submit support requests through the ticket system for us to address your issue. Support issues may also be submitted via email, phone, live chat, or support systems. In some cases, resolving issues may take time, so immediate support cannot be guaranteed. Issues are addressed by designated teams…
